Under prior law, federal tax law treatment for divorcing same gender couples was not as generous as for different gender couples but recent changes appear to have eliminate this discrimination. Nonetheless, the unstable nature of the law makes it extra important to consult with trained professionals, and often makes the Collaborative Practice model of divorce particularly beneficial to same gender couples because cooperation may provide more after tax money for the couple to split.
